Should driving while talking on a cell phone be outlawed?

Depends on the situation.

On one hand, passengers actually in the car can pose enough of a distraction to the driver that an accident is imminent.  If the driver is using a "hands free" device, then they're really putting the occupants of other cars and any pedestrians at no more of a risk than if the driver was talking to somebody in the passenger seat.

On the other hand, talking on a cellphone without such a device is not only distracting to the driver, but it also takes one of their hands off the wheel, creating a MUCH higher potential for an accident.  This is already illegal in some areas for just that reason, and personally, I agree with it.  As somebody who doesn't drive, I can point out several times where I've had the right-of-way when crossing the street and was nearly hit, and in one case, knocked off of my bicycle, due to the fact that some idiot couldn't keep control of their car while talking on their cellphone.
